An important gap in the immigration rules for dependants of graduate visa holders has been corrected by the UK Government, which had left some international graduates confused about the eligibility of their UK-born child to remain in the UK.

Changes effected in the Statement of Changes HC 259 mean that a child born in the UK while a parent has valid Graduate Route permission will be able to apply as the parent’s dependent. The new rule will be effective from 3 August 2026. 

This is encouraging news for affected international graduates, but it is essential to understand who qualifies and what the amendment leaves unchanged.

Why Was the Graduate Visa Rule Changed?


Partners and children were previously only allowed to apply for dependent eligibility through the Graduate route if they were already eligible for dependent permission in the Student route or the Tier 4 route.

This created an issue when a child was born after the parent had switched from a student visa to a graduate visa. While the parent was legally permitted to remain in the UK, the rules did not clearly provide a pathway for the newborn to obtain corresponding dependent status. 

The Home Office admitted this had left a “small number” of UK-born children without a “rules-based pathway” to regularise their immigration status. HC 259 has been introduced to close that gap. 

What Changes from 3 August 2026?


Under the amended rules, an eligible child can apply for dependent status under the graduate visa route if they fall under the following requirements.



Under the official rules, the child may be granted permission to stay in line with the graduate visa holder, provided the applicant meets the applicable requirements set out in Appendix Children. 

What the New Rule Does Not Allow


There is no general expansion of dependent rights under the Graduate Route by this amendment. It cannot allow a graduate visa holder to sponsor new children or other dependents from overseas solely on the basis of being granted a graduate visa. It only covers qualifying children that are born within that parent’s current graduate permission. 

The change also does not offer British citizenship or permanent residence. A child who is born in the United Kingdom will not automatically acquire British citizenship unless the necessary citizenship requirements are fulfilled. 

Parents will be required to provide documents and complete a dependent application. They should also consider the visa fees and Immigration Health Surcharge that will apply.
